1. Acceptance of Terms

Welcome to Ghostpost. These Terms of Service ("Terms") constitute a legally binding agreement between you and Ghostpost ("Ghostpost," "we," "us," or "our") regarding your access to and use of the Ghostpost website, early access programs, and social media audit services (collectively, the "Service").

By accessing or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated by reference. If you do not agree to these Terms, you may not access or use the Service.

2. Description of the Service

Ghostpost provides a privacy-first, automated social media audit platform. Users voluntarily upload official data export archives (such as zip files from Instagram, TikTok, X, Facebook, and Reddit). Ghostpost parses and scans these historical posts, comments, and media to highlight content that may pose reputational risks with college admissions committees, employers, athletic recruiters, or Greek life organizations.

Ghostpost provides analysis, categorical risk flags, and direct links to assist your review. Ghostpost does not connect directly to live accounts, does not collect passwords, and does not post or delete content on your live profiles.

3. User Eligibility & Account Responsibilities

• Age Requirement: You must be at least 13 years old to use the Service. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.
• Authority Over Uploads: You represent and warrant that you own or have the lawful right, permission, and authority to upload any social media archive or content that you submit to Ghostpost.
• No Unauthorized Third-Party Scanning: You agree not to upload social media archives or personal data belonging to any other person without their express written authorization.

4. Advisory Nature of Audit Results

Ghostpost is an automated advisory tool. Our risk scores, flags, and categorization are algorithmic assessments designed to assist your self-review. We do not guarantee:

• That our scans will identify every piece of potentially objectionable historical content.
• That any specific college, university, employer, or organization will or will not take action based on your social media history.
• Specific admissions, employment, athletic, or membership outcomes.

You are solely responsible for evaluating your content and deciding whether to retain, archive, or delete posts from your live social media accounts.

5. Acceptable Use Policy

You agree to use Ghostpost only for lawful personal or business evaluation. You agree not to:

• Upload archives containing malware, viruses, illegal material, or child sexual abuse material (CSAM).
• Attempt to reverse engineer, decompile, or extract the source code or proprietary classification models of Ghostpost.
• Scrape, harvest, or extract data from the Service using automated crawlers, bots, or unauthorized scripts.
• Interfere with, overburden, or disrupt the integrity or security of the Service or our infrastructure.
• Resell, sublicense, or commercially exploit Ghostpost reports without our prior written consent.

6. Intellectual Property

Your Content: You retain full ownership and intellectual property rights in the social media archives and data you upload to Ghostpost. By submitting archives, you grant Ghostpost a limited, non-exclusive license solely to process, scan, and display the audit results to you during your session. We do not use your content to train public artificial intelligence models.

Ghostpost Property: All rights, title, and interest in and to the Service—including our software, algorithms, user interface, brand assets, logos, and website design—remain the exclusive property of Ghostpost and its licensors.

7. Fees, Subscriptions & Refunds

Certain tiers or deep-scan features of Ghostpost may require payment or paid credits. Pricing is clearly disclosed prior to purchase.

• All fees are stated in U.S. Dollars and are billed in advance.
• We offer a 30-day satisfaction guarantee. If Ghostpost fails to complete your scan or you are dissatisfied with your audit, contact our support team at hello@getghostpost.com for a full refund.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT. GHOSTPOST DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL GHOSTPOST, ITS FOUNDERS, DIRECTORS, EMPLOYEES, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES—INCLUDING LOSS OF ADMISSIONS OPPORTUNITIES, EMPLOYMENT OFFERS, SCHOLARSHIPS, REPUTATION, OR DATA—ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

IN NO EVENT SHALL OUR TOTAL CUMULATIVE LIABILITY EXCEED THE GREATER OF ONE HUNDRED DOLLARS ($100.00 USD) OR THE AMOUNT YOU PAID TO GHOSTPOST IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

10. Termination & Data Purge

You may discontinue using Ghostpost at any time. You can permanently delete your audit results and uploaded archives directly from your account dashboard or by emailing privacy@getghostpost.com. We reserve the right to suspend or terminate access for any user who violates these Terms.

11. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to conflict of law principles. Any dispute arising out of or relating to these Terms or the Service shall be resolved through final and binding arbitration administered by the American Arbitration Association (AAA), except that either party may assert qualifying claims in small claims court.

YOU AGREE THAT ALL CLAIMS MUST BE BROUGHT IN YOUR INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.
